The keyserver administrators have to be running software that looks for this flag and then enforces the rule. Nothing forces a keyserver to do this except the social convention in the RFC (that is, there is nothing in the math that enforces this - it's just a request by the key owner). I don't know exactly now new it is, but the flag has existed at least since 1998 as it is mentioned in RFC2440. The HKP keyservers do not support it. I understand that some of NAI's LDAP key servers do support it, but don't know which.
